1. Acceptance
These Terms govern access to and use of RealtorTec, a SaaS platform for real-estate agencies and professionals operated by Pablo Antonio Cuadra Mantica, an individual doing business in Nicaragua under the registered trade name Total Realty, and offered under the RealtorTec brand. By creating an account, subscribing, accessing the admin panel, or using the service, the Customer and its authorized users agree to these Terms and the Privacy Policy. A person accepting for an organization represents that they have authority to bind it.
2. Eligibility and accounts
The service is intended for persons at least 18 years old acting for professional or business purposes. The Customer must provide accurate information, keep it current, protect credentials, configure internal permissions, and notify us promptly of unauthorized access. Each Customer is responsible for its users, agents, and administrators.
3. The service
RealtorTec may provide property, website, agent, lead, content, integration, automation, and related functions. Features may change to improve security, compliance, or performance. We do not promise uninterrupted availability and may perform reasonable maintenance. Any specific service level must be stated in a separate proposal or agreement.
4. Facebook and Instagram integration
A Customer may authorize RealtorTec through Facebook Login for Business or another Meta authorization flow to access administered assets and publish organic content. The Customer chooses the Page to connect and channels to enable. The Customer represents that it has authority over those assets and will maintain an eligible Facebook Page and, where applicable, a properly linked professional Instagram account. Permissions may be revoked at any time. Meta is independent, and its policies, availability, reviews, limits, and API changes are outside RealtorTec’s control.
5. Content and publication authorization
The Customer retains rights in text, images, videos, trademarks, and other content it supplies. The Customer grants RealtorTec a limited, non-exclusive, worldwide, revocable license—during the service relationship—to host, technically transform, display, and transmit that content only to operate requested features, including publication to connected accounts. The Customer must review accuracy, price, availability, copyrights, image releases, and legal compliance before publishing.
6. Lawful use and fair housing
The Customer will not use RealtorTec to violate laws, third-party rights, Meta policies, real-estate rules, advertising standards, or equality and non-discrimination principles. False, deceptive, discriminatory, illegal, malicious, infringing content; unauthorized personal data; and attempts to bypass security are prohibited. RealtorTec does not provide legal, brokerage, appraisal, or investment advice and does not guarantee any property.
7. Automatic publishing
If the Customer enables an automatic-publishing rule, it authorizes RealtorTec to create posts under the selected configuration. The Customer must be able to pause automation, select a default connection, and review content. Technical retries must not create duplicate posts. RealtorTec may pause jobs when it detects expired tokens, insufficient permissions, incompatible media, Meta limits, or abuse risk.
8. Third-party services
Facebook, Instagram, hosting, domains, email, storage, analytics, and other services are supplied by third parties and may be subject to additional terms. RealtorTec is not liable for third-party changes, suspensions, content rejections, account blocks, outages, or decisions, although we will make reasonable efforts to provide notice and reconnection where technically possible.
9. Fees and payment
Fees, taxes, billing intervals, limits, and cancellation terms appear in the applicable proposal, order, or plan. Unless agreed in writing or required by law, earned charges are non-refundable. We may suspend functions for overdue payment after reasonable notice.
10. Intellectual property
RealtorTec and its licensors retain rights in the software, design, documentation, marks, code, and service components, excluding Customer Content. These Terms do not transfer ownership. Copying, resale, sublicensing, reverse engineering, limit circumvention, or using the service to build a competing product is prohibited except where expressly allowed by law.
11. Confidentiality and data
Each party will protect the other’s confidential information with reasonable care and use it only for the relationship. Personal-data processing is governed by the Privacy Policy and, where applicable, a data processing agreement. The Customer must provide necessary notices and obtain permissions concerning agents, leads, owners, and other individuals whose data it enters.
12. Suspension and termination
The Customer may stop using and cancel the service under its plan. We may suspend or terminate access for material breach, security risk, unlawful use, nonpayment, an authority’s instruction, or an essential third party’s requirement. Where reasonably possible, we will give notice and an opportunity to cure. At termination, access licenses end; provisions that should survive by their nature remain effective.
13. Export and deletion
Before termination, the Customer should export available data it needs. We will process valid deletion requests under the Privacy Policy, deletion instructions, and law. Disconnecting Meta prevents new posts but does not automatically delete existing Facebook or Instagram posts.
14. Warranty disclaimer
To the extent allowed by law, the service is provided “as is” and “as available.” RealtorTec does not guarantee commercial results, sales, rentals, rankings, Meta approval, post reach, error-free operation, or perpetual third-party compatibility. Nothing excludes warranties that cannot legally be excluded.
15. Limitation of liability
To the extent allowed by law, RealtorTec is not liable for indirect, incidental, or special damages, lost opportunities, lost profits, Customer-caused data loss, or third-party decisions. RealtorTec’s aggregate service-related liability will not exceed fees paid by the Customer for the service during the three months before the event giving rise to the claim. This limit does not apply where prohibited by law or to willful misconduct or gross negligence where liability cannot be limited.
16. Indemnity
The Customer will defend and indemnify RealtorTec against third-party claims arising from Customer Content, missing rights or releases, unlawful or discriminatory real-estate practices, violation of Meta policies, or use contrary to these Terms, except to the extent directly caused by RealtorTec’s breach.
17. Changes
We may change these Terms to reflect legal, security, or service changes. We will publish the new effective date and notify Customers of material changes. If a Customer does not accept a material change, it may stop using the service before the change takes effect, subject to its plan.
18. Governing law and disputes
These Terms are governed by the laws of the Republic of Nicaragua, without prejudice to mandatory laws. The parties will first attempt to resolve disputes in good faith. Unresolved disputes will be submitted to the competent courts of Managua, Nicaragua, unless mandatory law requires another forum.
19. General
If a provision is invalid, the others remain effective. Failure to enforce is not a waiver. The Customer may not assign the agreement without prior consent except in a legitimate reorganization; RealtorTec may assign it to a service successor. These Terms, the Privacy Policy, and applicable commercial documents are the entire agreement concerning the service.
